Abstract
This paper will look at the U.S. Supreme Court Opinion of Town of Greece, New York v. Galloway Et Al., 572 U.S. (2014) while presenting arguments in favor of both sides, which also means critiquing both sides, namely the positions of Galloway and the town of Greece as to whether a constitutional violation took place. Specifically I will use critical philosophical tools available in dialectical reasoning to judge the strengths and weaknesses of the Opinion. [1] I will began with a critical deconstruction of the presuppositions that underpin the Syllabus of the Opinion. The paper concludes with arguments to reconsider framing the language the Establishment Clause within the First Amendment: this way we can better serve an increasingly diverse and pluralistic society with multiple, interacting religions and various ways in which offense is perceived and experienced due to religious expression in the public sphere.
